SHAH ALAM: 03 Jan – Gabungan Anti Penyelewengan Selangor (GAPS) dan Pertubuhan Pribumi Perkasa Malaysia (PERKASA) membuat laporan polis berhubung kenyataan Ahli Dewan Undangan Negeri (ADUN) Sri Muda, Shuhaimi Shafiei, yang dianggap menghina Sultan Selangor dalam laman blognya.
Pengerusi GAPS, Hamizun Khairuddin, berkata Shuhaimi dalam kenyataannya menerusi laman blog http://srimuda.blogspot.com pada 30 Disember lalu didakwa terang-terangan menentang keputusan Sultan Selangor, Sultan Sharafuddin Idris Shah, yang memperkenankan pelantikan Mohd Khusrin Munawi sebagai Setiausaha Kerajaan (SUK) negeri Selangor yang baru.
"Kenyataan ADUN itu seolah-olah memberi amaran bahawa Sultan Selangor akan berdepan dengan tindakan rakyat. Ia berunsur fitnah, menghina, menggertak, menggugut dan derhaka kepada institusi raja di Selangor.
"GAPS akan membuat laporan polis setiap hari di semua daerah sehingga ADUN tersebut dikenakan tindakan," katanya kepada pemberita sebelum membuat laporan polis berhubung perkara itu di Ibu Pejabat Polis Daerah Shah Alam di Seksyen 6 sini, hari ini.
Hamizun berkata, GAPS akan mencadangkan pertuduhan mengikut Seksyen 121 Kanun Keseksaan dikenakan terhadap Shuhaimi kerana perbuatan mengugut Sultan Selangor.
Dalam blog itu, Shuhaimi antara lain berkata jawatan SUK tidak memerlukan perkenan Sultan Sharafuddin Idris Shah dan sebaliknya ia adalah di bawah bidang kuasa Majlis Mesyuarat Kerajaan Negeri dan baginda seharusnya bertindak berdasarkan nasihat majlis berkenaan, bukannya berkecuali.
Malah, Shuhaimi menerusi kenyataan dalam laman blog berkenaan seolah-olah turut memberikan amaran kepada institusi beraja Selangor supaya tidak berterusan bertindak membelakangkan majlis mesyuarat berkenaan atau terpaksa berdepan dengan gelombang kebangkitan rakyat bagi menentang pihak istana. – BERNAMA

NOTA EDITOR: Secara mudahnya, keputusan perbincangan Menteri Besar bersama Baginda Sultan Selangor adalah:
1.0 Baginda mengakui tiada kuasa melantik Setiusaha Kerajaan Negeri ekoran pindaan kuasa-kuasa raja tajaan Mahathir pada tahun 1993.
2.0 Baginda mencadangkan Kerajaan Negeri Selangor berbincang dengan Jabatan Perkhidmatan Awam untuk menyelesaikan isu ini secara baik
3.0 Menteri Besar telah mengarahkan Speaker untuk memanggil persidangan khas meminda Undang Undang Tubuh Kerajaan Negeri bagi mengembalikan kuasa melantik SUK kepada Menteri Besar dan Baginda Sultan.

It was 20 months ago that Prime Minister Dato Sri Najib formally announced his 1Malaysia concept. We are now in a position to examine the challenges facing the idea, to reflect upon its achievements and to look ahead.
The first of the challenges comes from vested interests with a stake in perpetuating ethnic dichotomies that are inimical to national unity. Among Malays and Bumiputras, there are groups who abuse Special Position embodied in the Malaysian Constitution and in certain public policies to advance their own interests. They alienate not only the vast majority of non-Malays but also a significant segment of the Malay and Bumiputra populace. Likewise, the pronounced push for Chinese primary and secondary education within the Chinese community, in contrast to its passive approach to education in the national language, has created a great deal of disillusionment among Malays who feel that the former are not inclined towards integration that acknowledges the identity of the land.
A second challenge emanates from partisan politics. Some individuals and groups within the political opposition view 1Malaysia as a propaganda tool of the Barisan Nasional. They ignore the fact that 1Malaysia was presented to the people as a national mission on 3rd April 2009 by the Prime Minister in his capacity as the sixth Prime Minister of Malaysia. Besides, right from the outset, 1Malaysia was anchored in the Malaysian Constitution and linked to the Rukunegara and Wawasan 2020, which are instruments of nation-building, not political party manifestoes. If it had not been for this negative attitude of some politicians, which has an impact upon a portion of the populace, 1Malaysia would have gained more traction.
Certain unhelpful religious sentiments also impede 1Malaysia. There are influential elements in the religious establishment who do not realize that their narrow, bigoted interpretations of rules and regulations undermine that universal, inclusive spirit of Islam which reinforces the notion of common humanity that 1Malaysia envisages. O the other hand, there are non-Muslim politicians who are totally insensitive to Muslim feelings about Islamic etiquette, practices and institutions.
1Malaysia is also hampered by certain communal pronouncements and ethnic distortions and misconceptions which are ventilated more frequently than before in the public square. Words such as 'pendatang' and 'penumpang' directed at fellow non-Malay citizens are not only demeaning and degrading but also utterly reprehensible from the standpoint of our quest for national unity. They are, to some extent, a reaction to the constant attempts by a section of the non-Malay intelligentsia through cyber media to question the Malay position. Ludicrous arguments are trotted out such as that the presence of small pockets of Chinese on the Malay Peninsula for hundreds of years delegitimizes the Malay position. On the contrary, the very fact that they were well integrated into what were essentially Malay milieus, sustained by Islam, the Malay language and the Malay Sultanates, proves that the Malay polity was the precursor of the Malayan, and later, Malaysian nation-state.
In spite of these formidable challenges, there are certain achievements that one should attribute to 1Malaysia.
One, it has helped to foster – to a limited degree at least--- a feeling of 'togetherness' amongst a lot of young Malaysians. They understand 1Malaysia as an all-inclusive idea that embraces the nation's diverse communities. Our accomplishments in regional and international sports throughout 2010 have also contributed to this feeling.
Two, 1Malaysia has also been associated with the present emphasis by the government upon extending assistance to the poor and needy, regardless of ethnicity. That social justice is a more important consideration than ethnic or religious affiliation is a critical 1Malaysia message.
Three, for the first time, there is an earnest endeavour on the part of the government to recognize and reward ability and excellence, irrespective of ethnicity. The award of local and foreign scholarships to all 9A plus scorers in the School Certificate Examination (SPM) in 2010 was testimony to this.
Four, through 1Malaysia, efforts are being made to increase the intake of non-Malays in the Civil Service, the Police and the Armed Forces, and to ensure that there is greater mobility for them in these public institutions. Certain private enterprises dominated by one community at the managerial level should emulate this and also become more multi-ethnic.
In 2011 and beyond, apart from building upon our 1Malaysia achievements, the government, the opposition and civil society groups should do much more to overcome the challenges that confront 1Malaysia. Raising public awareness should become a more systematic and organised enterprise with the capacity to rectify serious inter-ethnic misunderstandings.
For instance, 'Ketuanan Melayu' is not --- as erroneously interpreted by the English language media--- 'Malay Supremacy'. It is more accurately described as 'Malay Sovereignty'. The fight against the Malayan Union in 1946 was an attempt to restore Malay sovereignty, crucial elements of which were later incorporated into the Malayan and Malaysian Constitution in the form of the position of the Malay Rulers, the status of Malay and Islam, and the Special Position of the Malays.
Suffice to emphasize loyalty to the Constitution today, without harping upon 'Ketuanan Melayu' which from a 1Malaysia perspective is divisive and detracts from our noble endeavour to strengthen inter-ethnic unity and harmony through common Malaysian citizenship.

The President of Malaysian National Union of Journalists Hata Wahari has issued a public call to Malaysian papers to stop being 'propaganda tools' of the Malaysian government.
In a press release, Mr Hata said:
"The union also asks editors of mainstream media especially Utusan Malaysia, New Straits Times, Berita Harian and the The Star to play the role of disseminating information to the public and not as propaganda machinery of the government, political parties, or any individual."
Mr Hata is responding to latest figures from the Audit Bureau of Circulations (ABC) showing decline in circulation in most Malaysian papers such as Utusan Malaysia, New Straits Times, The Star and Beritan Harian.
He also criticized 'racist' editors from Utusan Malaysia for flaming racial tensions and sentiments in Malaysia, leading to a 5.9 percent drop in its readership.
The Utusan group was founded in Singapore in 1939 by Singapore's first President Yusok Ishak and a group of Malay intellectuals. Utusan Malaysia's daily circulation has declined by nearly half from 350,000 ten years ago to only 170,000 now.
The proliferation of alternative news sites in Malaysia is fast eroding the readership and profitability of the Malaysian media which has often been decried as 'propaganda mouthpieces' of the Malaysian government.
Since 2008, the Malaysian new media has seen a dozen new players entering the scene such as The Malaysian Insider, The Malaysian Chronicle and Free Malaysia Today.
Singapore also has an association of journalists which is a toothless organization with little power or authority to take action against errant 'journalists', most of whom are under the payroll of Singapore Press Holdings, headed by a former PAP deputy prime minister.

[2:216] Fighting may be imposed on you, even though you dislike it. But you may dislike something which is good for you, and you may like something which is bad for you. GOD knows while you do not know.
The above reflects just how mandatory fighting is in the Quran, and thus, for all Muslims. It is reminiscent of how Saddam's troops were forced at gunpoint to fight when they tried to retreat.
[9:29] You shall fight back against those who do not believe in GOD, nor in the Last Day, nor do they prohibit what GOD and His messenger have prohibited, nor do they abide by the religion of truth - among those who received the scripture - until they pay the due tax, willingly or unwillingly.
Make no mistake about it - the "religion of truth" spoken of here IS Islam. The things prohibited are idolatry, and ALL faith in Jesus as anything but a failed prophet, as Islam asserts; faith in Jesus, TO Islam, is considered idolatry. Notice again the forceful nature to exact a tax "unwillingly" if necessary.
[9:111] GOD has bought from the believers their lives and their money in exchange for Paradise. Thus, they fight in the cause of GOD, willing to kill and get killed. Such is His truthful pledge in the Torah, the Gospel, and the Quran - and who fulfills His pledge better than GOD? You shall rejoice in making such an exchange. This is the greatest triumph.
"...willing to kill and get killed"? Can anyone find precedent for this kind of generalized KILLING and DYING fanaticism in the Gospel of Jesus (Matthew, Mark, Luke and John), as the Quran says? Can anyone show me from the four Gospels (or anywhere in Scripture) where "GOD has bought from the believers their lives and their money in exchange for Paradise". Can someone show me that? Please explain to me again how Islam is a religion of "peace and love"... I just don't see it.
Notice how there is NO mention of ATONEMENT FOR SIN. Islam, as with SO many other false religions, and it carefully avoids any conscience of sin or atonement, especially where Jesus is concerned. There is NO grace (by faith) involved at all - it is a religion based on the works of men's hands, and most of those, evil and brutal works. "Salvation" in Islam is based on one's willingness to fight and die only. Satan, in designing Islam, has employed the exact same common denominator found in so many other false and damning religions: AVOIDANCE of any faith in Jesus' blood and what He accomplished on the cross. That factor is ABSOLUTELY MANDATORY whenever Satan inspires sick men to create a new religion.
Why don't many Muslims fight? How does Islam continue to get away with the "love and peace" lie?:
[61:2-4] O you who believe, why do you say what you do not do? Most abominable in the sight of GOD is that you say what you do not do. GOD loves those who fight in His cause united in one column, like the bricks in one wall.
Notice how they are being scolded for NOT fighting. There are many suchs coldings throughout the Quran; according to the Quran, fighting and killing are the norm, not the exception. Ironically, more Muslims get killed in or because of their acts than they manage to kill, as Islam gets it's butt consistently kicked world wide. It's a marvel that such a self-defeating religion manages to last at all. But, as Jesus warned, there's a whole world full of people who are not His; Satan has free reign over them and their dark hearts and minds.
There are two basic reasons why many Muslims don't fight:
1. Mass ignorance of the Quran.
Most Muslims, like most "religious" hypocrites of today's many religions, don't have the first clue as to what the bulk of the Quran says or means. And, of those who do, they ARE the truly dangerous ones. The Quran (and Ahadith) are SO contradictory and confusing, that even Islamic Scholars can't agree on it. This is why there are so many divisions and diverse factions (often fighting against one another) within today's "unified" Islam.
Virtually ALL Muslims are cowards, in one way or another. Even among those who DO fight, they ALWAYS do it in very cowardly and underhanded ways (terrorism), preferring hit-and-run tactics to direct frontal confrontation. This is why you so often see Muslim extremists wearing masks and hoods; they are AFRAID of reprisal. Muslims can't begin to fight a fair fight, and, since "Allah" (the "Moon God") doesn't really exist, Muslims must do it ALL themselves (then "say" that "God" did it). If Muslims didn't do anything themselves, they would have NO "evidence" of Allah's existence or presence at all. It's clear from looking at Islamic countries, that Allah does NOT bless, prosper or help them, and the true and living God of Scripture can't even begin to endorse them, because of their craven tactics, motives and total lack of atonement for sin with subsequent spiritual regeneration (that inevitably occurs in true born again Christians who have met Jesus).

Secara peribadi saya ingin mengucapkan tahniah kepada Tan Sri Khalid Ibrahim, Menteri Besar Selangor yang telah mengambil keputusan untuk memanggil sidang Dewan Undangan Negeri Selangor untuk mengembalikan kuasa melantik 3 Ex-offico dalam barisan Exco Kerajaan Negeri kepada Kebawah Duli Tuanku Sultan Selangor dengan nasihat Menteri Besar. Ketiga-tiga jawatan yang dimaksudkan itu ialah Setiausaha Kerajaan Negeri, Pegawai Kewangan Negeri dan Penasihat Undang-Undang Negeri.
Dalam peruntukkan sekarang Kebawah Duli Tuanku telah dilucutkan kuasa melantik ini semasa krisis perlembagaan 1993 yang dicetuskan oleh UMNO pimpinan Dr Mahathir. Saya telah menulis isu ini acapkali didalam blog ini beberapa ketika dahulu untuk membayangkan kekesalan diri saya sendiri diatas tindakkan pemimpin UMNO semasa itu yang beriya-iya benar untuk menghakis kuasa Raja-Raja Melayu termasuklah kuasa Raja-Raja Melayu untuk melantik 3 jawatan Ex-Officio dalam Majlis Mesyuarat Kerajaan Negeri-Negeri diseluruh Negara.
Tuanku Sultan telah bertitah yang Baginda tidak ada kuasa untuk menerima dan menolak nama sesiapa yang dicadangkan oleh PSC kepada Baginda kerana kuasa itu telah ditarik balek hasil dari krisis perlembagaan pada tahun 1993 dahulu. Semasa itu UMNO bertindak tanpa sebarang 'mercy' kepada Raja-Raja Melayu dan kata-kata pemimpin kita semasa itu sangat mengguris hati orang Melayu seperti saya yang tahu tidak ada Melayunya seseorang itu tanpa Raja yang berdaulat.
Saya sedang tercari-cari potongan-potongan akhbar yang boleh membuktikan perlakuan pemimpin-pemimpin kita semasa itu tetapi sampai sekarang saya belum terjumpa lagi. Saya pernah berucap dimerata-rata diseluruh negara membidas tindakkan UMNO 'menderhaka' kepada Raja-Raja Melayu tetapi seperti biasa saya menjadi mangsa kutukkan pihak pimpinan UMNO kerana kononnya saya dan ramai yang lain telah menderhaka kepada UMNO.
Sekarang UMNO baru merasakan betapa lemahnya mereka dan dimana-mana pimpinan mereka sedang berlindung dicelah ketiak Raja-Raja Melayu. Sekarang Najib baru merasakan betapa pentingnya Raja-Raja Melayu dan pernah berkata didalam perhimpunan agung UMNO yang lalu yang Raja-Raja masih ada kuasa untuk melantik pimpinan Kerajaan jika ada pihak yang akan cuba untuk mengambil alihnya. Tetapi beliau selaku Ketua Pemuda semasa itu bersama-sama berlegar keseluruh negara untuk mendapat sokongan untuk melakukan kepada pindaan perlembagaan itu.
Sekarang UMNO pula yang menuduh pihak pembangkang yang menderhaka sedangkan kuasa Raja telah menjadi tirus seperti tali gasing yang dilakukan oleh pindaan perlembagaan dicetusan oleh UMNO semasa itu. Kepada semua yang membidas saya tidak berapa lama dahulu elok berfikir; siapa yang durhaka kepada Raja-Raja Melayu….UMNO kah atau pembangkang?
Saya bergembira kerana Negeri Selangor akan memanggil sidang tergempar Dewan Undangan Negeri Selangor untuk mengembalikan kuasa Kebawah Duli Tuanku dengan nasihat Menteri Besar seperti sebelum pindaan yang dilakukan oleh UMNO pada tahun 1993 dahulu.
Rupa-rupanya Pakatan Rakyat (PR) yang membuktikan mereka adalah pihak yang mengembalikan kedaulatan Raja-Raja Melayu. Jika UMNO jujur dengan apa yang mereka katakan sekarang Negeri-Negeri yang ditadbirnya mengembalikan peruntukan itu kepada peruntukkan asal semasa perjanjian persekutuan ditanda tangani dahulu. Ikutlah contoh Kerajaan Negeri Selangor jika benar UMNO mendaulatkan Raja-Raja Melayu. Jangan bercakap manis dimulut sahaja ibarat menanam tebu dihujung bibir.
Setelah dululuskan oleh DUN Selangor pindaan ini nanti maka Negeri Selangor akan menjadi Negeri yang pertama yang telah sedar dan bertindak membetulkan kesilapan yang dilakukan oleh UMNO pada tahun 1993 dahulu. Didalam sidang khas itu wakil-wakil UMNO wajar memberikan sokongan kepada usul pindaan itu jika UMNO benar-benar telah berubah dan mendaulatkan Raja-Raja Melayu seperti sebelum pindaan pada tahun 1993 itu.
Saya mengucapkan setinggi-tinggi tahniah kepada rakyat Negeri Selangor diatas kejayaan saudara-saudari sekelian.

SHAH ALAM 3 Jan. – Kerajaan Parti Keadilan Rakyat (PKR) Selangor mencadangkan agar diadakan Sidang Dewan Undangan Negeri (DUN) tergempar bagi meminda Undang-Undang Tubuh Negeri Selangor untuk kembalikan kuasa pelantikan tiga pegawai eksekutif termasuk Setiausaha Kerajaan (SUK) Negeri kepada Menteri Besar dan Sultan Selangor.
Menteri Besar, Tan Sri Abdul Khalid Ibrahim berkata, beliau akan menulis surat kepada Speaker DUN untuk memaklumkan mengenai cadangan itu.
Menurut Abdul Khalid, beliau juga telah mengadap Sultan Sharafuddin Idris Shah hari ini mengenai isu pelantikan SUK itu.
Katanya, baginda mencadangkan supaya kerajaan negeri mengadakan perbincangan dengan suruhanjaya Perkhidmatan Awam (SPA) untuk mencari penyelesaian terbaik.
Sehubungan itu, katanya, beliau akan menulis surat kepada SPA bagi membincangkan calon yang layak.
"Sebelum penyelesaian muktamad dicapai, maka kerajaan negeri tidak mahu terlibat dengan sebarang majlis atau keraian dengan SUK.
"SUK juga tidak boleh hadir mesyuarat Exco atau hadir pada Majlis Mesyuarat Kerajaan Negeri tetapi boleh melakukan kerja-kerja seperti menguruskan hal tanah dan sebagainya," kata beliau pada sidang akhbar tergempar di sini hari ini.
Ujar beliau, ini bermakna majlis angkat sumpah di hadapan Menteri Besar tidak akan diadakan.

The National Union of Journalists (NUJ) demanded today for Umno-owned Utusan Malaysia to cancel a domestic inquiry on one of its journalists, who is also the union's new chief.
NUJ president Hata Wahari, who was elected to the post last September, has been hauled up by his employers over his criticisms against the Malay daily. He will face a domestic inquiry on Thursday and is at risk of being sacked.
NUJ Malaysia general secretary Anbalagan Veerasamy defended the union's president today, saying he was only exercising his duty to protect his fellow journalists and uphold media ethics.
"NUJ president Hata Wahari had made his remarks as a union official, and Utusan is free to make a public rebuttal if it did not agree with NUJ's statements," he said in a statement.
He added that the Umno mouthpiece should respect the rights of NUJ officials to make public statements which relate to the interests of union members.
"NUJ is deeply concerned by the domestic inquiry on President Hata Wahari by Utusan Malaysia, and will monitor the developments closely," Anbalagan warned.
Hata has been critical of his employers as well as being outspoken about the freedom of the press and the importance of non-biased reporting. In a recent statement, he kicked off the new year by blaming Utusan editors and what he called their racial rhetoric for the daily's declining sale.
He also called on the authorities to act against the paper's editors for fanning racial sentiment in its reports.
Executive officer for media interest group Centre for Independent Journalism (CIJ) Masjaliza Hamzah has also demanded that the Malay daily not punish the journalist for his outspokenness on the matters of press freedom.
"This is his job and he's doing his job as the president of NUJ. He does have a national stature, they would sometimes need to say critical things in the course of serving the national duty," she told The Malaysian Insider today, adding that he should not be penalised for it.
She claimed that this was the only time that a NUJ's leader has stood up to protect the integrity of journalists and not give in to unethical media practices.
"Perhaps for the first time [Malaysian journalists are] getting the union they deserve. [T]his is the first time, an NUJ leader has come out with a strong statement that is critical of the media organisation covering an issue, and I guess in this instance, it happens to be the media organisation he also works for," she said.
Masjaliza said that CIJ will continue to pressure the Malay daily as they had "gotten away" with the sacking of Amran Ahmad, who was the chairman of NUJ-Utusan Melayu before his dismissal in September 2010.
Amran was sacked in last year following a report he made to the Malaysian Anti-Corruption Commission (MACC) over procurements made by Utusan Melayu Berhad, the company that publishes Utusan Malaysia.
"In many ways, they got away with sacking the previous NUJ branch chair, so I think it's about time they listen. They cannot act with impunity. There are ethical standards to follow, that Utusan also needs to follow, just like other media organisations," she said.

The mainstream newspapers are 'government's propaganda tool'. They belong to the ruling party and its components. New Straits Times, The Star, Utusan Malaysia, Berita Harian and others, name it. Just like Harakah, Suara Keadilan and Rocket playing 'tools' to Pas, PKR and DAP propaganda.
My advise to National Union of Journalists (NUJ) of Malaysia president Hata Wahari, dont tell them what to do. I mean our mainstream papers - the group editors or editor-in-chief and their managing editors are political appointees. They have to play dumb and obey all instruction from the top or out they go.
Since 1980, I have seen many changes to the helm of each newspaper companies, especially when a new leader took over the government. Each prime minister would like to install a new team who could safeguard and protect the interest of the government.
You yourself have seen a few, bro. I am not disputing what you said Sunday that Malaysian newspapers should stop becoming 'propaganda tools' for the government. You were damn right about it but you missed something - that this mainstream papers either belong to Umno, MCA, MIC or other BN component parties.
The only different is in their trend. During the 1980 and 1990s, they were business-driven. They competed among each other to win high readership and big revenues from advertisements. However, they turned into politically-driven since the era of Tun Abdullah Ahmad Badawi. Most of them begun to lose to new media and new newspapers.
Why? The 'play balls' too much. The editor-in-chief are merely puppets to top politicians. They are the best 'yes-men' the country ever had. If not for sports and entertainment pages, the whole content of their newspapers would be attributed to party and individual news. So much so, readers got fed up and stop buying and reading.
Aaahhh!!! This is what our newspapers are all about, bro! Asked NUJ former president Yazid Othman about it, or any other senior journalists, including those who have retired. Its a fair game as the two groups got their own masters to support and protect.
However, I salute your guts in making such statements, i.e "The union also asks editors of mainstream media especially Utusan Malaysia, New Straits Times, Berita Harian and the The Star to play the role of disseminating information to the public and not as propaganda machinery of the government, political parties, or any individual."
It was a frank and open statement. But please remember, being frank sometimes doesnt pay...

Khusrin's appointment violates nation's founding principles

A bizarre and comical drama is being played out in the running feud between Malaysian ruling coalition Barisan Nasional (BN) and opposition alliance Pakatan Rakyat (PR).
BN is attempting to force an unwelcome top public servant down the throat of a PR-controlled state government, which naturally has fiercely resisted the forced-feeding. The scenario is rendered more ridiculous when, in its earnestness to overpower PR, BN has brought in the Sultan of the state to administer the swearing-in of the new recruit, though the Sultan, being a constitutional monarch, has no apparent role to play in this appointment under the state constitution.
On 27 Dec 2010, the Chief Secretary to the BN-controlled federal government Mohd Sidek Hassan suddenly announced that Selangor Islamic Department (Jais) Director Mohd Khusrin Munawi will take over as PR-controlled Selangor's State Secretary (head of state civil servcie) from 1 Jan 2011.
This unexpected news came like a bolt from the sky for PR, for Khusrin , well known for his pro-Umno and anti-PR stance, is regarded as a thorn in the flesh in the Selangor state government. Within hours, Selangor Menteri Besar's office refuted the appointment, stating that the Menteri Besar had no prior knowledge of it, and that the state government was still in the process of finalizing the appointment from its own short-list. Menteri Besar Khalid Ibrahim was then on oversea leave.
In a chorus of angry protests, PR leaders described this sneak attempt to appoint a hostile candidate to head the state's civil service as an outright sabotage against the PR government. They accused Prime Minister Najib Razak of trying to replicate the infamous coup d'etat that overthrew the PR state government of Perak almost two years ago when a similarly pro-Umno state secretary played a key role in the illegal power grab.
Another surprise awaited PR. On 30 Dec 2010, the Sultan's private secretary Mohamad Munir Bani (apparently another Umno loyalist) announced that Khusrin was scheduled to swear-in at the Sultan's palace on 6 Jan 2011, for which invitations have been sent out. This move is clearly intended to pit PR on a collision course not only with Umno/BN but also the Sultan, keeping in mind that both chief secretary Sidek and private secretary Munir had stated earlier that the Sultan had given his approval to the appointment.
Meanwhile, controversy over the legality and propriety of this appointment rages on with a variety of opinions from the academic and the judicial circles. However, before we delve into the legal intricacies, let us first look at the issue from a commoner's point of view.
A few facts need be straightened out first.
The state secretary is a state government employee, whose salary is paid for by the state government. He heads the state's civil service and serves the executive council (Exco) of the state (the state cabinet) and reports directly to the menteri besar.
Hence when the federal Public Services Commission (PSC) selected Khusrin as Selangor's state secretary, it was in effect serving the Selangor government as a personnel agency. The Selangor government remains the employer.
Does it make sense then that PSD should have selected someone without the knowledge of and without consultation with the Selangor government, the Exco, and above all, big boss the menteri besar?
It is akin to an employment service agency thrusting a general manager to a company without the knowledge of the chairman and board of directors. The latter must be thinking that the agency has gone mad!
Now we are talking about running a government, which is immensely more complex and serious than a company. Is it not the height of absurdity that the federal recruitment agency would appoint someone to head the civil service of an adversary state government in a process that was completely hidden from the latter? Worse, when that candidate is a putative 'trojan horse' to sabotage the state government!
How is the new state secretary expected to serve his employer when the former is regarded with such mistrust and detestation? Isn't this move a manifestation of evil intention to cause grievous damage to the PR state government? Isn't this the crudest expression of contempt and betrayal of the interests of the Selangor people who have chosen PR to administer their state?
Now, let us look at the legal aspects.
Under the state constitution (Article 52 Clause 1), the appointment of the state secretary "shall be made by the appropriate Services Commission" - not by the Sultan. So, both Sidek and Munir have falsely invoked the name of the Sultan to over-rule objection from PR.
Next, the state secretary must take his Oath of Secrecy "in the presence of the Menteri Besar" before he can attend meetings of the Exco, according to Article 52 Clause 4 of the same constitution.
With these two provisions, it is apparent that arrangement of Kushrin's oathing-taking in the palace is not an orthodox constitutional practice of the state, but an expedient political machination devised to outmaneuver PR.
As for which is "the appropriate Services Commission" mandated by Article 52 Clause 1 for this appointment , Menteri Besar Khalid contended that the state's own Public Services Commission should have been involved in accordance with services practice notes prepared by the Commission.
While the issue of the "appropriate Services Commission" is being debated, one thing is crystal clear. The employer has the final say as to who can or cannot work for him. No government can tolerate a key officer who is an anathema to its agenda, much less the head of the entire government machinery. It is against all norms of justice and fair play. It is certainly against the democratic principles upon which this nation was founded.

According to reprots, Khalid Ibrahim had an audience with his Highness the Sultan of Selangor this morning and after leaving the palace he announced that a special session of the state assembly will be held to allow him to made amendments to the Selangor State Constitution that would allow him to appoint a State Secretary.
How is he going to do it?
Pakatan does not have two-third majority in the house and even if he locks out all BN state assemblyman and gets a unanimous vote on the amendment, he still cannot amend the constitution as it requires that two third of all state assemblyman to vote in favour..not two thirds of the quorum or two thirds of those in attendance...
Maybe Khaldi's legal advisers are telling him something else but it looks like the state sitting will just be a fare, a way to hit at the Sultan and embarrass him
One also wonders if PAS will take part in the madness as they have privately gone to indicate support for His Highness and Ketuanan Melayu recently.
Khaldi also annoucned that he will not attend the swearing-in and he will not allow Kushrin to take the oath of secrecy before him....
Well that would prevent Kushrin from attending any Exco meetings but apparently it would not stop him from attending the legislative assembly...
And so DAP and Khaldi hs successfully created an impasse in Selangor and with the principal officer in charge of the administrative affairs unable to attend Exco meetings, the State Government is also paralysed.
