Year of the Tiger – What Portends in 2010

The beginning of the New Year of 2010 and the beginning of a new decade and as we ponder on happenings of the past we will naturally wander into and about the future.

For ages since the beginning of civilizations people's thoughts are into the eternal space of time flowing from the future to the past as in "coming and going" in an encyclical nature. (He he, yes , the past comes from the future in meta-psychics and returns to the past...)

The study of cycles is today universal as with the study of astronomy or physics which is the concept of frequency and frequencies as in occurrence and oscillation (oscillate; as from a psychics, binary or mathematical perspective). Any discipline of study will never be complete without the study of its cycle or the forces of it.

Everything moves in a fix pattern like the earth's orbit of the sun or the moon's orbit of the earth in coherence with the earth's cyclical orbit. Everything is in motion and moves and vibrates in a systemic pattern collectively in line with the oscillation of the entire universe.

The ancients have studied these movements and formulated their findings into a mathematical form of symbols and its permutations, Astronomy is the most ancient of the sciences and it is today common knowledge that the moon and the sun influenced the movements of the tide in the sea in a cyclical pattern. A point of note here is that today the subject of astronomy and astrology is detached from each other and astrology is not a mainstream science subject however the study of cycles and patterns are a component of the modern sciences.

Well, I think this bit of introduction on cycles is adequate for our purpose here today as we are going to relate the economic cycle to the ancient astrological chart. And it must be pointed out here that it is the intention to simplify the presentation based on historical facts on to the major astrological cycle and will not be looking at greater intensity of the mathematical permutations and even than it is an eye opener at what is being presented here today.

We are going to look at a certain cycle of the year of the Tiger from the Chinese astrology and in particular this year of 2010 is the year of the "Golden Tiger" (or Metal) which will come in to effect on February 14th. The Tiger or "Yin" (name of the Tiger in the Chinese astrology) is the third cycle of the 12 year astrological cycle. The Tiger inherent element is "Wood" with the polarity of "Yang" (of the male female principle as in Ying and Yang) and occupies the direction of ENE (east – northeast) and rules the hour from 3am to 5am of the 12 Chinese hours. There is a conflict of the elements here this year with Wood – Metal configuration. There are a wee bit extra detail here just for info but we will not cover details and degree of intensity of the interaction of the mathematical symbols and or permutations of the elements. We are going to just look at the occurrence that is happening in the financial world and more specific in relation to the American stock market or the Dow Jones which inevitably affects the whole world.

Below is an old base research chart of mine that can indicate a lot of other information but for now we will cover the cycle of the Tiger on the financial world.

The boxes highlighted in yellow in general indicate an economic boom and the boxes in grey highlight the recession years (for Malaysia).

The Tiger box being highlighted covers seven cycles from 1938 to 2010 and we shall see what happens during those years from a financial viewpoint with special reference to the Dow Jones of the United States of America (USA).

  •  We will look at 72 years ago from 1938, the year of the Earth Tiger where the Dow had fallen to below100 points again si from a high of almost 200 points in 1937 after the great depression years from 1929 to 1933 and where the Dow started recovering from 1934 and ended with the beginning of World War II in 1939. (See Chart  1930s Below)

  • The next Tiger Year is of the Metal element in 1950 and again the Metal element here is significant of war and saw the beginning of the Korean war which saw the Dow taking another dip and lasted until 1953. The war was aggravated with Chinese forces entered on North Korea's side that saw the war in a stalemate with either side making any progress. (See chart below)

  •  Another exciting year for the Water Tiger in 1962 which saw the Dow falling almost 25% from over 730 points to 558 points. This is the year of the Cuban Crisis and the beginning of the cold war with Russia that result in the assassination of President John F.Kennedy in 1963. (See Chart Below).

  •  How brutal is the Tiger and in 1974 of the Wood Tiger we saw another recession that saw the Dow crashing after breaking the 1000 points level in 1973 by more than 50% to 577.60 points in december 1974 and it would be another 10 years later that saw the Dow hitting the 1000 level again in late 1982. (Chart Below)

  •  1986 The Year of the Fire Tiger although milder as wood (Tiger's original element) fuels the fire that gave it some stability and saw the outbreak of Insider Financial Scandals in the corporate world as most of you will remember the blockbuster movie featuring Michael Douglas as the greedy Gordon Gekko in "Wall Street" of 1987. The outbreak of Insider trading in 1986 led to the great crash of 1987 with the Dow crashing from a high of over 2700 points by almost 1000 points as the biggest drop on record with a climax of about 23% drop in one day of October 19 making it a record drop ever. (Chart Below)

  • The Earth Tiger returns in 1998 to haunt the financial world resulting in the Russian Crisis that saw the collapse of the  Russian financial market which was triggered by the Asian financial crisis of 1997 that saw the crash of oil and commodity prices which makes up 80% of Russian exports and saw the highest inflation ever reaching above 80% with prices of basic food rising up over 100% This crisis was reflected in the Dow which plummet by about 2000 points from over 9300 points to 7500 points. (Chart Below)

In Conclusion
The Tiger Cycle in relation to the financial world is unique as every Tiger year  for the past cycles going as far back as there are records, the Dow Jones of the USA crashes and here i would like to stress a point that the Chinese character for crisis is made up of the words "danger" and "opportunity". In every crisis there is a great opportunity for gains and sometimes much bigger gains are being presented. I have known investors that have made a lot of profits from this Tiger cycle and i hope this presentation would caution you to the danger that lurks as well as alerting you to the chance that might be coming your way.

In the ancient description of the Tiger, it is one that symbolises power, passion and courage. The Tiger also signifies change, rebellion and is unpredictable. It is believed that the Tiger commands awe and respect from the four quarters and is revered as the sign that  fends off the three dangers of fire, thieves and ghosts.

Note: This is an ongoing research and i believe there has not been a presentation of this nature in terms of the relation of the financial world to the cycles of the astrological chart. This presentation has been made simple for easy understanding.

Assalamualaikum Warahmatullahi Wabarakatuh.

If there's one thing I notice ever since I started taking photos with the Nikon D5000 DSLR camera, is that I get people posing for me on their own free will.

I didn't get that much enthusiasm from those who were in my lens viewfinder before.

















Hehehehe...call it what you will but the excitement is really there when I aim my lens at anyone whom I find interesting enough to take a shot with the obviously quite a professional piece of photographic equipment.

















People are just ever so willing to pose naturally here when they realize my aiming my camera at them.


































That's quite a change. :)

I have had quite a few people stop and ask me as to which newspaper I am from?

















Here I am getting the 'thumbs up' from a passing motorist!

Maybe it's just the people here in the East Coast of the peninsular but the respect and natural warmth I feel from my subjects is just very encouraging. Alhamdulillah!

Using the Nikon D5000 surely gives me a brand new perspective in capturing the sights and visual delights that open up from behind the viewfinder of this camera.

Using the Nikon Coolpix 200 was different. I had to rely on the autofocus all the time and had to really use my skills in capturing certain shots and photo ops.

The DSLR which I have now been blessed to own is opening up a whole new vista for me in the field of digital photography. Syukur Alhamdulillah!

Now, let's see some nice views that I managed to capture at Tanjong Api, Kuantan, Pahang recently.

















This is a fishing vessel that is having its propeller repaired.


































The propeller is made of solid copper and looked really quite heavy. The boatyard operators were having quite a tough time fixing it back to the fishing boat.

















The sight of them working on it however made a good photo opportunity and yours truly didn't miss capturing it all for you.

When I was a young boy back in Penang, I used to see the boatyard operator besides my kampong, build and repair wooden lighters which were called 'tongkangs' at Lian Seng Shipyard at the very end of Jalan Tengku, East Jelutong.

I doubt whether such services are still available in this age of steel and fiberglass?

Even though the defence produced documents to account for Anwar's movements for every day over that period, Augustine Paul ignored the evidence and found Anwar guilty.

By convicting Anwar, Augustine Paul solely relied on the framed up allegations of the witness, Azizan Abu Bakar, who was shown by the defence team to beunreliable.

Augustine Paul was infamously called the "irrelevant judge" for repeatedly refusing submissions of evidence by Anwar's defence team and ruled them 'irrelevant'.

augustineObviously a judicial officer without anyproper talent noteworthy, he had been a sessions court judge, until one week before Anwar's sodomy trial. He was promoted promptly to be a high court judge and took on the case. After serving his part in the political conspiracy, he was summarily promoted to be a judge of Court of Appeal on 1 August 2003, and then on to be a judge of Federal Court, the apex court in Malaysia, on 17 June 2005.

He ruled on Apr 16, 2009 that Perak Assembly Speaker V Sivakumar does not have the power to suspend Mentri Besar Datuk Zambry Abd Kadir and six state executive council members from attending the assembly. It is a decision that was made in blatant defiance of Article 72 (1) of the Federal Constitution which says,"The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court".

The judges of the Federal Court have failed the people and the government of this country when they chose to ignore the law of the Constitution of Malaysia. In other words the judges have refused to do justice according to law.

Incidentally, ultra vires does not mean "outside the law". It means "outside one's jurisdiction, beyond the scope of one s power or authority". And we may ask, who is the Federal Court to say what is beyond the jurisdiction of the Speaker when the supreme law of the country says that "the validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court".

He was born October 12, 1944 in Batu Gajah, Perak. He had his early education at Sultan Yusof School, Batu Gajah and Anderson School, Ipoh. He was called to the Bar of Inner Temple, London in 1971 and obtained his Bachelor of Laws Degree from the University of London as an external student in 1979. He is married to Dr Mary with two children, Dr Juliana Sharmini and Alan John.

You will go down in Malaysian History as the most unprincipled and corrupt judge ever ton sit on the bench. Don't think you can quietly slink away into your burrow to enjoy all the illgotten gains because you will one day have to face justice. Ditakuti membenarkan penggunaan perkataan Allah oleh bukan Islam akan menaikkan sensitiviti kaum serta dieksploitasi oleh pihak2 seperti UMNO.

Menjaga keamaanan lebih penting bagi Tulang Besi. Adapun hukum penggunaan pula masih lagi di khilafkan. Sebenarnya masa isu ni timbul, Tulang Besi telah buat 'research" di internet, dan rata-rata artikel dalam internet yang dalam bahasa Inggeris TIDAK MENGHARAMKAN ORANG BUKAN ISLAM menggunakan nama Allah. An addition to the third voice

Ever since the Pakatan Rakyat (PR) held its first ever convention, much has been written about its pledges to Sarawakians and Sabahans in its Common Policy Platform. Polls are here, there, and everywhere.

Opinions and analysis combine to effectively put the baby PR on notice, to put it mildly. One can even interpret some reports as containing mild threats, of trying to influence voters not to choose PR.

I would like to add a few observations too. For example, will the PR still give the promised 20% oil royalty to Sarawak, if Taib, Jabu and Masing are still in control? If Taib et al remain in power at state level, they will decide, absolutely, how the money will be spent, where and on what. Inevitably, they will decide who will get what!

Then we move onward to the struggling Native Customary Rights (NCR) landowners in Sarawak. Will they ever get to exercise their rights to self-determination, if the PR takes over Putrajaya and Petra Jaya in the capital Kuching? After all, it remains a mere PKR promise to right the countless wrongs under the BN, as far as the NCR lands are concerned.

From the little that I can gather from a few outlets (blogs and news portals only), the disappointment, to put it gently, expressed against PR is obvious. Authors pick and choose, depending on where each of them is coming from, to highlight the gaps left behind by the PR since the March 2008 political tsunami.

PR and local democracy

There are two reminders on the local council elections by RPK and activist Wong Chin Huat (or the lack of it) by what many consider as the PR's promises for local democracy, now broken.

Then there is the skepticism over whether PR can deliver anything else beyond the "feel-good" statement and, dare l say, some sense of hopelessness as shown in the headline, 'Get real, Pakatan Rakyat'.

Last, but certainly not least, is the latest piece by Dr. Kua Kia Soong, which looks beyond the two-party system, and thus beyond the PR. Dr Kua reminds Malaysians that beyond the two coalitions in the two-party system in which the PR is positioning itself, there is a 'third force'  - comprising NGOs and civil society groups.

This more comprehensive critique goes beyond the broken promise of the PR in getting the local government election in place. Dr. Kua lists several other broken promises and then highlights what he sees as the neo-liberal similarities in policies between the BN and the PR. And that third voice is "an activist movement that continually makes demands outside Parliament in order that the peoples' interests will be served".

I see all these essays as being part of a healthy debate, rightly reminding firstly the voters to be vigilant, and then the PR to live up to its promises and be pro-active in its newly given mandate. Allow me to contribute to that debate, by enlarging the boundaries that are being drawn with each article that appears on the subject of PR's common policy statements.

Broadening PR's perspective in Sabah and Sarawak

My intention here is to broaden the perspective, so that Malaysians in general and Sarawakians in particular will realise that broader reforms are needed beyond certain specific pledges, and that Klang Valley-centric debates must not be mistaken as the only voice of dissent, even against the PR.

Put more specifically, the different levels of urgency and the different priorities as articulated and argued from the Klang Valley, or other key urban centres in Semenanjung Malaysia, are not Sarawak's priorities.

Making such a statement is in no way intended to reduce the importance and urgency of these critical issues, or to suggest that the authors are narrow-minded or portray their concerns in a negative light. On the contrary, these views are on record as being rather consistent progressive voices, of our severely curtailed society.

The reason why l highlight where these critical analyses are coming from, is to place what l see as the realities into the context of any discourse in Malaysia.

Among the very first in my list of realities in context is that Sarawak and Sabah are not Malaysia – socially, economically, culturally, politically and historically. As such, there is the danger of these critical analyses falling into the same category of so many other analysts, local and foreign, in then prescribing a Malaysian "answer" for Sabah and Sarawak.

Now I want to qualify this further by saying that l am not a subscriber to 'territorialism' so as to be dogmatic for a Sarawakians' Sarawak or Sabahans' Sabah. I believe Sarawakians must earn, and have earned that respect, not out of rhetoric, as shown by the few experienced activists around and the countless others who are not known publicly.

In the absence of any sustainably coordinated defence of Malaysians' rights and resistance against 46 years of UMNO-led authoritarian, police-state and its fundamental divide-and-rule regime in the Federation of Malaysia, the 20-month old baby PR coalition remains the best candidate to be the "alternative" to the BN.

History everywhere has shown that radical and abrupt social, economical and political changes do not occur overnight. In the Malaysian context, the "third force" has been at the forefront of countless critical issues, before the March 2008 political tsunami, in which political parties were still trying to overcome the racial divide.

While this is not to say that the PR is now free from racist elements, it needs to mature fast to remove all traces of racism and opportunism among its leaders and rank-and-file members. While many within the PR might think time is on their side, I say many voters will view the honeymoon period as being over.

As has been suggested by many observers, PR must announce to the public that PR-ruled states will apply its applicable common policies within a set time frame. The PR-ruled states can start the new year and the new decade by striving to implement their common policies or platform, as the only way to determine if their common platform is applicable overall.

Four states trying them out will firstly prepare the personnel within the PR component parties and the civil service, to be ready to walk the talk. It will reveal how broad-based PR's support truly is. Trying them out before the next general election will allow fine-tuning and most of all, to demonstrate to the voters how serious and practical the common platform is. Then come the next general election, the voters will have good reason to mark the PR's scorecard.

For Sarawak NCR landowners, the four PR states can put in place how they propose to carry out the PR's common platform, regarding native customary rights over lands, as applicable to the Orang Asli communities and what remains of their forest resources. Otherwise, doubts will persist when fundamentally, the PR is still about neo-liberal economic policies, even though they are supposed to be carried out "with a human touch".

So, it is over to you, PR!

As long as the Christian newsletter that uses the word "Allah" has a

KUALA LUMPUR: The Government is calling for calm among Muslims and non-governmental organisations and asking everyone to respect the court's decision over the use of the word Allah while it takes steps to appeal against the decision.

Minister in the Prime Minister's Department Major-General (Rtd) Datuk Jamil Khir Baharom said the groups should be patient and allow the matter to be resolved through the legal process.

"I will meet the NGOs soon to hear their views and to discuss further the matter with them," he said in a statement on Saturday.

On Thursday, the High Court allowed the Catholic weekly, Herald, to use the word Allah.

Judge Datuk Lau Bee Lian had ruled that usage of the word was constitutional as long as the periodical was confined to educate the followers of the Christian faith.

Former prime minister Tun Dr Mahathir Mohamad, meanwhile, said the High Court's decision allowing the Catholic weekly publication to use the term Allah must be governed by strict conditions.

He said whatever justifications offered for the approval, it would not diffuse the anger of Muslims in the country.

"This is because 'God' in other religions is translated as 'Tuhan' in Bahasa Melayu or Arabic, not 'Allah'. "Allah specifically refers to God in Islam. If they understand that, they would use the word 'Tuhan', not 'Allah'.

"I accept the term 'Allah' had been used in Sabah and Sarawak before the two states joined Malaysia but it is difficult to stop them from doing so now... but in the peninsular, we have not heard of such practice," he told reporters after presenting a keynote address at the Malay Undergraduates Convention at Universiti Malaysia Terengganu here on Saturday.

Dr Mahathir said what he was afraid of was that the term Allah might be used in such a way that could inflame the anger of Muslims.

"They may use it on banners or write something that might not reflect Islam," he said.

In George Town, the police said it would station personnel outside the High Court building here Sunday following a planned demonstration by a Muslim non-governmental organisation.

State police chief Deputy Comm Datuk Wira Ayub Yaakob said his men would only move in if the demonstration turns chaotic.

"The protesters must know their limits," he said when contacted.

DCP Ayub said police have not received any application for the gathering so far.

In Pasir Gudang, a group calling itself the Pemuda Islam Melayu Pasir Gudang held a peaceful demonstration in a field in Taman Mawar against the decision.

The group's leader Ramli Ahmad, who is also Umno Pasir Gudang youth information chief, said non-Muslims should use the word God instead of Allah.

He said the Council of Malay Rulers should intervene in this issue.

Improve the quality of drivers

The recent bus crash that killed 10 passengers in Ipoh was a real tragedy that could have been avoided if only certain rules were adhered to by the driver, his employer who owns Sani Express and the relevant enforcement agencies involved in ensuring safety of public transportation. The tragedy also highlights certain weaknesses in the transportation industry that should be remedied if we want to prevent recurrences in the future. It appears that we have not learnt from the experience of the Bukit Gantang tragedy 2 years ago where 22 people lost their lives in a similar accident on our highways.

The 38 year old driver of the ill-fated bus was reported to have a clean record and the bus was new and in good condition. The driver however has admitted that he fell asleep at the wheels at the time of the accident. It is clear that he was too exhausted to drive in the first place let alone handling a double-decker bus in the wee hours. Why did he continue despite feeling sleepy and tired? Why was he allowed to continue without adequate rest? The Transport Ministry has clear guidelines on road safety for express buses including working hours and rest for drivers. Why were these not adhered to?

Double-decker buses are meant more for use within the city and may not be ideal for highway driving as they are generally less stable at higher speeds. Handling of these buses is different and requires more skills than the usual single-tiered ones. The drivers of such buses need special training to handle them especially during emergencies. The transport ministry must come up with proper guidelines for the safe operation of these buses as they have become necessary due to the increasing number of travellers especially during holidays and festive periods.

Low wages is the underlying cause of poor quality of express bus drivers. Financial demands forces them to undertake long working hours which virtually drains them off their physical and mental energy when they report for work especially for late night driving. It is not uncommon these days for workers, particularly from the lower income group, to resort to multiple jobs to boost their income. Relying on income from a single job will not be enough to make ends meet considering the high cost of living particularly in urban areas.

Bus companies must operate their services more professionally and be responsible for the comfort and safety of the passengers. Though profits are important it must not be at the expense of the safety of the passengers. They must recruit drivers with the right attitude and commitment by higher wages and better perks. These would not only attract better and experienced drivers but will reduce their need for multiple jobs or working long hours thereby will be in better mental and physical state when they report for duty.

The government should keep the pressure on bus companies to ensure that safety measures are not comprised for monetary gains. Better wages, perks, regulated working hours and training for them will go a long way to ensure a more committed and responsible fleet of drivers operating the express buses plying our roads and highways.

The job of an express bus driver, like a pilot, is a very responsible one as the lives of many are in his hands. Unless we take it seriously and get only the best for the job there is no way of preventing further tragedies like this. The Ipoh tragedy offers another lesson for the authorities to improve buck up.Whether they learn from it is yet to be seen.

It is time for the government to improve other forms of public transportation as our roads and highways are fast becoming congested and too risky for travel especially during weekends, holidays and festive periods. Even the rest areas are too congested for drivers to take a break even if they is hungry, tired or sleepy.

SHAH ALAM: As 2010 dawns, the Malaysian court is making an attempt to bulldoze its sodomy case against Opposition Leader Anwar Ibrahim through the courts.

Anwar's lawyer S.N. Nair said the Registrar of the Federal Court–the highest judicial authority–is trying to force his firm under impossible circumstances to go ahead with the hearing of an appeal on Jan 6.

"The procedure adopted in relation to the matter is certainly unprecedented and does not, and cannot, serve the end of justice," said Nair in a statement .

The statement from S.N.Nair and Partners reads:

"In relation to the section 51A Criminal Procedure Code documents, the Court of Appeal allowed the appeal of the Public Prosecutor on 6.11.2009 following which, on 17.11.2009, Datuk Seri Anwar Ibrahim appealed to the Federal Court against that decision.

"By fax transmission dated 29.12.2009, my firm was informed by the Registry of the Federal Court that the Federal Court had fixed the date of hearing of the appeal on 6.1.2010.

"In the same letter of notification, my firm was also asked to file the Petition of Appeal on an urgent basis.

" My firm was taken aback by this development because the Record of Appeal had yet to be served on us as at the date of notification of the hearing.

"On 30.12.2009, my firm received a letter dated 23.12.2009 through Poslaju, serving on my firm the Record of Appeal and the Additional Record of Appeal. By Rule 95(1) of the Rules of the Federal Court 1995, my firm is required to file a Petition of Appeal within a period of ten days after service of the Record of Appeal.

" Clearly, in the circumstances, the Petition of Appeal is required to be filed by 9.1.2010.

"The 9.1.2010, which being a Saturday and therefore a holiday, with Sunday being an intervening holiday, my firm is required to file the Petition of Appeal by 11.1.2010.

"It is impossible under the circumstances for the hearing of the appeal to proceed on the 6.1.2010.

"In any event, Mr. S. N. Nair of our firm who is the solicitor in charge, left for India on 28.12.2009 and is only due to return in the late evening of 5.1.2010.

"The procedure adopted in relation to the matter herein is certainly unprecedented and does not, and cannot, serve the end of justice."

Anwar has maintained that the allegation against him is politically motivated by the government of Prime Minister Najib Abdul Razak.

He was charged with sodomy in 1998 after being sacked by former Prime Minister Dr Mahathir Mohamad and forced to serve time in jail but the charges were ultimately quashed during the reign of Prime Minister Abdullah Badawi.

The latest move against to speedily put him on trial on Jan 25 is seen by his supporters as an attempt to remove him from the political scene.

Legal circles have been questioning the rejection of Anwar's application to strike out the sodomy charges.

When fixing the dates for the hearing from Jan 25 to to Feb 25, judge Mohamad Zabidin Mohd Diah ruled that medical reports could not serve as the basis for the court to use its inherent powers to strike out the charge.

However, the court ruling was met with cynicism from opposition lawyers who dismissed the judgment as political in nature.

According to a Nut Graph report, the Court of Appeal's interpretation of Section 51A of the Criminal Procedure Code (CPC), by which it made its judgment, is worrisome from a justice perspective.

The judgment nullifies the efforts of the parliamentary select committee which proposed the CPC amendments in 2006 requiring pre-trial disclosure by the prosecution to the defence.

The legislature's intention was to "prevent trial by ambush" but the Court of Appeal's judgment in Anwar's sodomy case seems to overturn that principle.

But is Section 51A as clear cut as it was meant to be? And is splitting hairs over its meaning scuppering Anwar's chances for a fair trial?

Section 51A was introduced to widen the scope of evidence that the defence could obtain from the prosecution. At first reading, it comes across as a clear obligation for the prosecution to make available to the defence evidence that it intends to use during trial.

Section 51A . Delivery of certain documents

1. The prosecution shall before the commencement of the trial deliver to the accused the following documents:

a. A copy of the information made under Section 107 relating to the commission of the offence to which the accused is charged, if any;

b. A copy of any document which would be tendered as part of the evidence for the prosecution; and

c. A written statement of facts favourable to the defence of the accused signed under the hand of the Public Prosecutor or any person conducting the prosecution.

The meanings of the words "shall" and "any document" are clear, a member of the Bar Council's criminal law committee, Baljit Singh Sidhu, who is also the author of Criminal Litigation Process, has been quoted as saying.

"The intention of 51A is to put both parties in a trial on equal footing in the interest of justice. That was parliament's intent. The word 'shall' should be taken to mean 'must.'

"If the court does not interpret 'shall' as being mandatory, then there is no point to the amendment."

Baljit is also Gerakan Federal Territory legal adviser.

"Any document" should also be taken to mean any type of evidence, Baljit adds. It is all the more important when it involves evidence like DNA, for which scientific expertise and time are required if defence lawyers are to analyse it.

However, the Court of Appeal in Anwar's sodomy case decided there were "limits" as to the kind of evidence the prosecution could be asked to produce before a trial.

Hence, it overturned the High Court's decision ordering the prosecution to hand over evidence, which included video footage, medical reports, doctors' notes, and witness statements of alleged victim Mohd Saiful Bukhari Azlan and others.

The bench, in rejecting Anwar's cross-appeal for DNA specimens held by the prosecution, also said that the evidence requested did not fall under the category of evidence in 51A.

"The amendment [to the CPC] is as good as non-existent," Anwar's lawyer Nair was quoted as saying.

Danish police late Friday shot and wounded a man close to radical Somali Islamists who tried to enter the Aarhus home of Kurt Westergaard, who drew controversial cartoons of Islam's prophet Mohammed, Danish security sources said.
The Danish cartoonist, who has received several death threats since a Danish newspaper four years ago published his drawing featuring Mohammed wearing a turban in the shape of a bomb, was at home in Viby near the western city of Aarhus when the 27-year-old and two others tried to get in, daily Politiken reported online.
Guards repulsed the three intruders as security alarms were set off, and the wounded man was hospitalised.
Denmark's Ritzau news agency said a dozen police vehicles were at the scene while sappers were sent in to look for a bomb that might have been laid.

Contacted by AFP, Jutland police confirmed an incident near the home of the 74-year-old cartoonist but refused to give details pending the release of a statement later.
Westergaard is one of 12 cartoonists whose drawings of the Muslim prophet were first published in Danish newspaper Jyllands-Posten in September 2005, sparking controversy among Muslims worldwide.
The 12 cartoons were considered offensive by many Muslims and their publication sparked violent protests worldwide in January and February 2006.
Demonstrators burned Danish flags in protests that culminated in February 2006 with the torching of Danish diplomatic offices in Damascus and Beirut and dozens of deaths in Nigeria, Libya and Pakistan. - AFP

Since Justice Lau's brave decision to allow the Herald to continue publishing its Malay language edition using Malay-speaking Christians' normal term for God ("Allah"), there has been a flurry of condemnations from several quarters.

One of them, Dato' Ariff a.k.a. Sakmongkol wrote an especially incisive article in his usual strong intellectual thrust. In that article, he postulated that the issue was not about the legality or right of Christians to use the term. The real issue was that "Allah" is the exclusive reference to God for billions of Muslims worldwide "and hence, the hijacking of its ownership through some legalistic twists, constitute a rape and pillage on the Muslim person."

He further asserts that this ownership of the term Allah "rests on the altar of worship supported by the pillars of faith jealously guarded by UNREASON" and therefore not open to rational discussion.

Respectfully, I must strongly disagree based on the following points.

1) The "exclusive ownership" argument has been rebutted ad nauseam, ad infinitum. I am loathe to repeat it. You can read my extensively researched arguments against this flimsy premise here. I'll merely briefly mention here that the term "Allah" (and its various permutations) have been in use to refer the the "One Supreme Being" in the Middle East region since before Islam, Christianity or even Judaism! These great monotheistic religions simply adopted the word to express their faith.

So what exclusive ownership?

2) Equating non-Muslim use of the word "Allah" as raping the Muslim personhood? Come on la!

If we were to accept this argument, then Christians should demand that all references to Jesus Christ should be stricken out from the Quran! Because belief in Jesus resides in the hearts of all Christians. Belief in the doctrines about Jesus Christ also rests on the altar wof worship supported on the pillars of faith! Should Christians regard Islam's reference to Jesus in a completely different doctrine as a rape and pillage on their faith and personhood?

Since Christianity came 600 years BEFORE Islam, by virtue of seniority Muslims should respect and obey the wishes of Christians should such a claim arise that the Quran's Jesus conform to Christian doctrine or be stricken out altogether, just as some Muslims expect the same of Christians re "Allah"!

I'm not saying we should get into a semantic tug-of-war. But put forward your arguments by all means, just let's not be hypocritical about it!

3) To state that "The word Allah...rests on the altar of worship supported by the pillars of faith jealously guarded by UNREASON" is, I think, Dato' Ariff's most damaging statement to his cause.

In all of Creation, God created only Man to have reason. It is by the exercise of reason that Man is able to control his base desires and grow in his faith, through spiritual disciplines such as worship, prayer, fasting, study and reflection. No other creature in the world is able to do such things simply because they are beings without reason!

Since God created Man as the only creature with "reason", and Man's growth in his faith in God rests on activities that require the exercise of reason, the implication is that as Man grows in his closeness to God, he exercises MORE of his reason.

Stating that faith is guarded by UNREASON is surely an insult to the sincere spiritual seeker!


You think it is going to be a good year?

So it's the new year. Some of you have made resolutions. Some are looking forward to a good and productive year. Some might even be optimistic that things will change for the better in Malaysia. I happen to fall in all 3 categories. Yeah I'm a sentimental old guy. So sue me.

And so I thought I'd start off the new year by posting something that I found really funny. I saw it in the news portal The Malaysian Insider today. Let's call it The Case of The Missing Jet Engines.

The engines said to be worth RM100 million, were found missing after an audit in 2007. A police report was only lodged in early 2008 but the matter only came to light last month. This is after all the average speed things run here in Bolehland. 2 years. Quite good already. But not as good as what is to follow here...

Prime Minister Najib Razak was defence minister when the engines went missing. So whatever the outcome and whoever the thieves are it is ultimately the responsibility of the then minister in charge. Isn't it? Not here in Malaysia.

Inspector General of Police Tan Sri Musa Hasan has already announced that three low-ranking airmen and a company agent were the only ones involved in the theft. With one quick press statement all the top guys are exonerated. Kao Tim! No problem.

Also, it is only in Malaysia that the Inspector-General of Police can make a pronouncement like that even before the case has finished investigations and gone to court. Yup! Only 3 low-ranking airmen and an agent involved. Nobody else need be bothered by this. Didn't somebody else also make the same kind of pronouncement in the case of the exploding model?

Therefore you must understand the distinction between the two.........We don't want other religions to use it as it (the word Allah) refers to the one and only God. Now that the High Court has allowed the usage of the term Allah, soon any religion can apply their own reasoning to use the word Allah. Imagine if a deity were to be referred to as Allah. Surely it would create a lot of tension."

And to think that this man was put in charge of Malaysia's richest state for years. Scary!

WE ARE THE UNACKNOWLEDGED LEGISLATORS OF MALAYSIA

In any democracy it is the voting populace that that make the resolution to change the system of a government. We are a sovereign nation. Since achieving independence some 52 years ago our forefathers have on the basis of a balance of convenience faltered in the exercise of their democratic rights. They chose leaders who sold our constitutional rights to the United Malay National Organization (UMNO).

They did not choose astute political leaders. The leaders failed to uphold our political trust. Hence they destroyed our social trust vested on them. They transformed our political trust into a vacuum which we in March 2008 consigned to the dustbin of history. Now at least some form of change has been set in motion on the running of our government. This has given rise to some form of checks and balance.

Based on the psychological reasoning of a large cross-section of the current voting populace regardless of their ethnicity, the people are inclined to exercise their power of the expression of their thoughts, and want to rise up and shake of the existing government's political mobilization, which have been premised on ethnic lines.

As Malaysia has a population of 35% who are at the age bracket of 25 years and below, we have a new middle class of the voting populace that have realized that the existing government's ethnic based social policies have as a whole been disruptive on social cohesion. This is also owing to the fact that there now exist the issue of inter-racial marriages that are taking shape.

Further, the government has instead of maintaining and improving upon the principles of democratic governance and creating a better civil society, have ensured that UMNO politicians have had a card blanch to exploit racial and religious issues and gain political mileage to obtain and consolidate their power base. At all cost these UMNO politicians strived to enhance their popularity and have enlisted the power of the Royal Malaysian Police Force (PDRM) to quell any form of passive resistance that arose.

On the other hand the affirmative action policy of UMNO which was introduced in 1970 has not reduced the inequities between the various ethnic groups, which include a large section of the ethnic Malays. It only discriminated against the ethnic Chinese and Indians.

There is no doubt that the quota system for entry into tertiary institutions did help to create a new Malay middle class. But in the process it created serious interethnic disparities on wealth generation and on the income of other ethnic groups including the ethnic Malays and the Bumiputras which has no legal meaning.

However, the UMNO politicians of the past which includes Mahathir realized that the government with all its powers could not compel even with legislation and administrative orders, an acceptable market dominated policies. Faced with this daunting task, the government incorporated a large number of Government Linked Corporations (GLC). These GLC's predominantly employ ethnic Malays. The sad fact is that almost all the GLC's are a loss making entity, which have been established at the expense of the tax payer.

Then, with preferential entry into tertiary institutions, we have created a large section of "mediocre highly qualified professionals" who pass with the barest of the minimum marks and upon graduation join the civil service and do not have "character." Hence, we have now inherited not only a government that lacks in character and integrity but a mediocre civil service which lacks commitment, instinct, initiative, integrity and character.

This prevailing scenario has given rise to the lack of competency, accountability and transparency where the end result is the institutionalization of cronyism, nepotism and wide scale corruption.

It has been the hallmark of good governance, in any institution, that leaders have to be astute and with that naturally comes intelligence and instinct and the ensuing result would be an impressive leader(s) who would have integrity, who we can respect. But, we currently do not have such leaders.

What we have before us in the UMNO leadership, the GLC and the civil service, are "Ali Baba and the 40 thieves", robber barons and murderers.

As these political leaders are so consumed with their megalomaniac acts, they seem to be unaware that there is a transformation taking place within our communities and our wider society. There is a new form of political mobilization taking shape where the barriers created by UMNO to divide and rule the various ethnic groups, are being dismantled.

In its place is set in motion multicultural party politics that evolve to the challenge of totalizing in character, and unifying the diverse ethnic groups into one common platform. This is in reference to the "Common Policy Framework" document recently issued by the Pakatan Rakyat.

The current youths in our society do recognize the commonalities in their outlook in life and shun the regulations, religious or otherwise, that are imposed upon them against their will. They want to have a free space to expound their thoughts and actions, without any  interference from the regulatory authorities.

There is currently a transformation taking shape and is deepening amongst the middle class youth which points to the inter-linkages amongst people of different ethnic backgrounds. This has arisen owing to the fact that during their daily activities at their place of work or because of their duties and responsibilities entrusted upon them and to complete their assignments there is an inclination that gives rise to there being some form of close contact or engagement with each other.

Then, there also arises the new form of business co-operation taking shape both in the traditional business environment where the second or third generation of the minority ethnic communities, have taken over the reigns of power or partnerships are being formed in the knowledge based sector of the economy, where business is established on the basis of mutual benefits.

Here there is a growing interest in interethnic business ties being further enhanced and put into practice. So, it gives rise to the opportunity for the building of an increased interethnic character which would eventually lead to a closer bond of understanding being established where inter-racial harmony will prevail.

Whilst our government has all along endeavoured to "divide and rule" the people, it was the people who have since March 2008 demonstrated to the government, that such policies have to be consigned to the dustbins of history.

Resulting from the simple act of casting a vote with our conscience for democracy and a better civil society, Najib announced the 1Malaysia Concept. This announcement clearly demonstrates that the government has given recognition to the fact that we are "unacknowledged legislators" who can through our concerted and united acts bring about change.

We should not compromise the fact that 5 decades or so ago our founding fathers received a "Constitution" which emphatically and categorically stipulates in Article 8 that "All persons are equal before the law and entitled to the equal protection of the law."

Based on the Najib's government's policies, we can clearly discern that the government has a trait of fickleness or fluidity in the making of policies. We as the unacknowledged legislators can over time make the government to change their mind for the creation of a better and equitable society and demand that the government make an announcement that they have done so.

We should demand for policies that lead to the integration of the various ethnic groups on the basis of equality and such policies should resonate amongst the people. Should the government not heed to our call for change, then as the Greek poetic Archilochus said, we should say to them: I am a "Fox" that aspires to be a "hedgehog."


Special New Year Greetings From Barisan Nasional

This year Malaysians will need to spent extra monies from their incomes , as Barisan Nasional government had announced the increase on price of certain items in 2010. The items which prices had been increased with effect from 1st January 2010 are :-

  1.  Sugar. The price of sugar has been increased for 20 sens per kilogram. Before the increase, the price of sugar in Peninsular per kilogram was at RM 1.45 and RM 1.55 in Sabah and Sarawak. According to the Domestic Trade, Cooperatives and Consumerism Ministry secretary-general Datuk Mohd Zain Mohd Dom, who made the announcement, said the increase in the sugar price was necessitated by the rise in the price of raw sugar in the world market, and that the government still subsidised the price at 80 sen per kg or RM1.008 billion for the year.
  2. White Bread. The government also announced that it withdrew its subsidy on white bread and removed the commodity from the price control scheme.
  3. Cigarette Minimum Price Regulation. With effect from 1st January 2010, the smokers will need to pay more on their cigarettes as BN government had came up with the minimum price for cigarettes regulation.With this regulation, a minimum price for 20s cigarette will be sold at RM 6.20.
  4. Credit Card Service Tax. Card holders will need to pay RM50 credit card service tax on all principal credit card and RM25 for every supplementary card. The tax according to BN government was to discourage unwise spending by card users.

The price increase of sugar, white bread, cigarettes and the imposement of Credit Card Service Tax will have serious consequences on the public especially the lower income group.
 
Plights by some Iban in the Longhouse  
 

My recent visit to Kampong Empaling and Kampong Tekuyong, which are under P202 and N25, when told about the price increase on certain items that affected them such as  the price of sugar and cigarettes, most of them were not happy with the government.
According to them, in 2008 when the government increased the price of petrol, most of the price of items were shoot-up. The effort by the government to reduced the  price  of petrol in the same year did not help much as its did not bring down the price of items.
Their villages head, TR Ngulu and TR Jawan also informed Bukittunggal that most of the subsidies promised to the longhouse people such as petrol and diesel subsidies for their generators and the rice subsidy until now has not reached them. They added with the new price increases announced by the government it will affect the life of people in the longhouses badly.
 
My Advice To the Voters in the Longhouses.
 
PM Najib slogan ""1Malaysia. People First. Performance Now" " is just a rethoric. So far he and BN government have done nothing in helping the people.
Enough is Enough. The people of the longhouses must supports the PAKATAN RAKYAT in the coming State Election.

Breaking News-Augustine Paul Passes Away

2nd January 2010



Federal Court judge Datuk Seri S. Augustine Paul, who shot to prominence for presiding over Datuk Seri Anwar Ibrahim's 1998 corruption case, has died today of an undisclosed ailment. He was 64.
It is not known what caused his death but he had been bed-ridden for some time. It is understood the funeral will be held tomorrow.
Paul was first appointed as a judicial commissioner on Sep 1, 1996 before he was elevated to the High Court on May 15, 1998.
He presided over Anwar's sodomy and corruption trials where his remark "irrelevant, irrelevant" was the most quotable quote from the proceedings.
He was made a Courts of Appeal judge on Aug 1, 2003, and later joined the Federal Court bench on June 17, 2005.

IS HULU SELANGOR PARLIAMENTARY SEAT GOING TO BE VACANT ?

There are strong speculations that the Hulu Selangor Parliamentary seat is going to be declared vacant paving the way for the first elections for the year 2010 since the PKR MP Datuk Dr Zainal Abidin Ahmad is reported to be seriously ill.

A survey around this parliamentary area seem to sense a election is about to take place with coffee-shop talks.

The Opposition leader and PKR leader, Datuk Seri Anwar Ibrahim is expected to make the announcement tonite although there are also reports that no such thing is about to take place.

We need to wait and see if a election is called.
