"Ummi Hafilda is a prostitute," said Aziz Samsuddin
Day three of Anwar Ibrahim's appeal hearing at the Kuala Lumpur Appeal Court hit a high note today when Christopher Fernando read out transcripts of the previous trial that quoted Aziz Samsuddin as saying Ummi Hafilda Ali is a prostitute.
Fernando started by recapping yesterday's proceeding where he had told the court Ummi had been disowned by the father after she confessed to writing the letter to the Prime Minister, Dr Mahathir Mohamad, accusing Anwar of sodomising Azizan Abu Bakar, one-time driver of Anwar's wife, Dr Wan Azizah Wan Ismail.
Ummi's father, a religious teacher, just before he died, wrote an open letter to the Harakah detailing the reasons he had disowned her and, in no uncertain terms, implicated her as the prime mover behind Azizan.
"Ummi's father died broken-hearted without ever forgiving his daughter for the role she played in framing Anwar of sodomy charges," related Fernando.
Fernando had earlier read out Azmin Ali's (Ummi's brother) testimony in court that proved she played an active role in the whole conspiracy.
The prosecution never called her to testify in court to rebut this allegation, added Fernando. Instead they expected the defence to call her. The judge, in fact, even mentioned this point in his written judgment.
"But Ummi would have been a hostile witness so it should have been up to the prosecution and not the defence to call her," argued Fernando.
Fernando said that the court should have invoked Section 114 (g) of the Evidence Act on the prosecution for failing to call a most crucial witness to testify in court.
Fernando then took the court through the testimony of Raja Kamaruddin Raja Wahid, a.k.a Raja Komando, who had, in fine detail, revealed how the conspiracy against Anwar originally unfolded and the role he was given in this whole conspiracy.
"The evidence of this witness will show he was invited to join the conspiracy with a view to topple the Deputy Prime Minister," said Fernando.
"The meeting was held in the office of Aziz Samsuddin, the Prime Minister's Political Secretary, on 26 June 1998."
In the meeting, revealed Fernando, Aziz confirmed that Ummi and Azizan would pose no problem as "Ummi is a prostitute".
Raja Komando then asked Aziz whether there was any other way to bring Anwar down.
According to Raja Komando, "Aziz replied sodomy would be the best way. Other ways would have no affect."
"Raja Komando's role was to manage the political assassination part of the exercise," added Fernando. "The sodomy allegation was assigned to Ummi and Azizan."
"Raja Komando was to disseminate the allegation as far and wide as possible. He was also to spread word that Anwar is a CIA agent."
From what Fernando told the court today, it was clearly established in the meeting Raja Komando had with Aziz Samsuddin that he (Aziz) was the Chief Conspirator and that, while Ummi had written the purported "Azizan" letter to the Prime Minister accusing Anwar of sodomy, Aziz was the one who had edited and redrafted it.
The letter, Fernando said, was based on the book "50 Reasons Why Anwar Cannot be PM" – which somehow found its way into the attaché bags of almost 2,000 delegates at the Umno General Assembly that year.
"The judge did not give this evidence the weight it deserved," argued Fernando. "He erred, grossly."
"If he had given the evidence the weight it deserved, would he have arrived at the judgment he did?"

Special Branch investigation proves Anwar is innocent
Earlier, the Kuala Lumpur Appeal Court was told that Said Awang, the Special Branch Director then, had approached Azmin Ali, then Anwar Ibrahim's Chief Private Secretary, to make an appointment to meet Anwar.
In the meeting with Azmin, Said Awang solicited his help to persuade his sister, Ummi Hafilda, to retract the sodomy allegation against Anwar.
From this testimony, it is apparent that not only was it the Special Branch that approached Anwar and not Anwar who summoned them (and therefore "abused his power"), but that they knew it was Ummi who was behind the allegation, and a false one at that.
On the third day of Anwar's appeal hearing in the Kuala Lumpur Appeal Court, Fernando told the court that Said Awang testified he had written a letter to the Prime Minister on 5 August 1997 confirming that not only was Anwar innocent of the sodomy allegation, but that there was a conspiracy at the highest level to frame him.
"Said Awang confirmed that Tun Daim and Rahim Thambi Chik were in the conspiracy," said Fernando.
"He also confirmed that Dato Seri Anwar is not guilty and a victim of a conspiracy."
"Said informed the PM that, from their intelligence gathering, there is no basis for these allegations. In other words, these allegations are baseless."
"Said's letter also talks about a conspiracy by certain people with their own agenda to get Ummi and Azizan to smear Dato Seri Anwar."
"After a thorough investigation, they came out with the report to the PM."
From this testimony, it shows that as early as 1997 the conspiracy to get Dato Seri Anwar already existed. The Prime Minister even defended Anwar by saying that the allegation is false and was fabricated by certain people who do no want to see Anwar becoming PM. In fact, even the Chief of Police then shared this view and said so.
"The PM came out with an even stronger statement that whoever believes these rumours must be stupid and should be shot," said Fernando.
"The conspirators wanted to prevent Anwar from becoming the Prime Minister because he had introduced draconian amendments to the Anti Corruption Act in an attempt to clean up the government."
"And all these conspirators had something to lose if this happened and they were worried."
"In one transaction alone, Tun Daim (illegally) made RM600 million."
"Rahim Thambi Chik had RM39 million in one back account. And that's only the one we know about. How could he, on his Chief Minister's salary, have accumulated so much money?"
"Rafidah Aziz had four charges of corruption against her. And the Attorney-General, Abdul Gani Patail, had signed the papers recommending prosecution."
However, the trial judge refused to allow all this to be raised in the trial.
"Time and time again the judge gave the benefit of the doubt to the prosecution whereas he ought to have given it to the defence," lamented Fernando.
"The judge ignored basic fundamental principles of law. He is in fact guilty of judicial misconduct."
"Whenever there was any testimony in favour of Dato Seri Anwar he would block it."
"This happened to every single witness without exception."
"Irrespective of whether the court is convinced in its own mind of the guilt or innocence of an accused, its decision must be based on the evidence adduced and nothing else."
"Whether the judge agrees that a crime has or has not been committed is irrelevant. The decision must be based solely on the evidence."
In Anwar' case, however, the judge consistently and flagrantly blocked all favourable evidence and prevented witnesses from being called. Even while the witnesses were testifying and it looked like the testimony was in favour of Anwar, he would stop the witness halfway without allowing him or her to finish.

beyond the hypocrisy of New York Time Square's ball-dropping
of those screaming and yelling amidst confetti falling
More than just a night of fireworks in the sky, adorning,
Of drag racing,
Of disco-dancing
Of well-wishing
Of drunk-driving
And next, another year of national forgetting
… a nation in amnesia we are made to be in
Let us not forget what must lie ahead
As we retreat to the "cave"
To think of shadows on its wall
And to reflect upon the "doctrine of reminiscence"
… the river of forgetfulness we drank from, intoxicated therein
In this cave we congregate
And begin to look at this Reality we have constructed
Inside and outside of us as we are made to become cogs
in the wheels of Industry
Inside and outside of us we build Neon Gods and bow down to these
and their creators
Inside of us we have become these Gods
In the cave we must contemplate
The nature of revolution we must initiate

The first convention by Pakatan Rakyat and the launching of its framework for change interests me as a student of Chaos and Complexity theory.
I have always been a disinterested observer of Malaysian politics since the first day Dr Mahathir Mohamad got into office and ruled for 22 hegemonic years.
Many might say that we are better off than Sierra Leone, Rwanda, Afghanistan, Pakistan or even Zimbabwe, as popularly quoted. The media continued to harp on the idea of 'gratefulness of what this country has given to her people".
Media spin doctors over the decades have played on this theme of Malaysia's abundance and plenty whilst peoples of other countries live on landfills and huge garbage dumps.
But why compare to these countries and not to Switzerland, Sweden, Singapore, or even Denmark and New Zealand. Those African countries are failed states. Many of them, borrowing Gabriel Garcia Marquez, are run by generals who build labyrinths for their people.
Uganda, especially under Idi Amin the dictator has been a long gone case. Rwanda is a gone case. Sierra Leone is painfully recovering. Nigeria is a gone case. South Africa is recovering very slowly.
Zimbabwe is out of this world. Robert Mugabe was still holding on to power whilst his people en masse eat from garbage cans and get mass diarrhea.
Malaysia might be travelling down the road of these nations if the trend of authoritarianism is not halted. To have one in power for two, three, four, or five terms is a recipe for Zimbabwe-isation of nations.
Nations go through Kondratieff cycles of ups and down and a lot of these have got to do with the political-economic structure of the country and the level of its people's understanding of democracy.
How we treat cats and dogs in Malaysia compared to how Americans do it for example tells us the level of democratic consciousness these two nations have mastered.
Indicators of serious deterioration of Malaysia's state of civility, respect for the rule of law, democratic institutions, accountability, transparency, guarding of financial institutions – all these are evident especially after the veil of authoritarianism of Mahathirism is lifted.
Data and anecdotes from the Wall Street Journal writer Barry Wain in his book Malaysian Maverick suggest the colossal magnitude of the problem – Malaysia's road to Zimbabwe. The impact, cyclical it may seem, will be felt sooner. The street protests we have been seeing over the last few years are an indicator of the breakdown of civility.
Averting Zimbabwe-isation
From my reading of the situation in Malaysia, we will be seeing a most interesting next General Election in which the forces of change will be met with the forces of control.
I foresee that this is a natural progression of this country's path towards not becoming a Zimbabwe. The old regime is going to face a big challenge this time around because Nature will dictate the process of change.
"Power tends to corrupt and absolute power corrupts absolutely," said Lord Acton. Essentially one cannot allow many-term rule – example abound in Africa – from Idi Amin to Sani Abacha and beyond. In Asia – from Suharto to Marcos to all those despotic leaders.
The recent declaration of a coalition of the three Opposition parties (Pakatan Rakyat) is an indication of the natural progression of political events.
The end of Mahathir era, as a postmodern theorist would say, signal a 'rupture' or a 'breakaway' or a Kuhnian revolution (a term to describe a paradigm shift/Scientific Revolution in which the Copernican idea is replaced by Galileo's) in Malaysian politics.
We are seeing a two-party system evolving and we must be ready for this big change – a "megatrend" as futurist John Naisbitt would say. Naisbitt, Alvin Toffler, and Lester Thurow would have predicted that phase of Malaysia's evolution.
When one sees the data on the magnitude of corruption and wastage during the regime of Mahathir Mohamad, can one not make a conclusion that we are indeed in trouble as a country? Troubling at least and one thinks of this – how did all these happen and what will be the future of this beloved country if this trend continues? How could the entire nation let this happen?
Malaysians must understand that major shifts in political-economic and socio-cultural are inevitable when the condition is ripe. It is an evolving process and cannot be stopped. The challenge is to accept changes and work within the framework and to become critical of any government that will assume power.
We might even have to learn how to think like an American – either of the Democrat or Republican American – and be ready to depose of any regime that is not meeting the needs of the people. The American Revolution is based on this idea – to oppose taxation without representation.
When the people are alienated from the ruler and when they suffer while the ruler goes all over the world parading wealth and power and consuming conspicuously, the 'social contract' or the agreement between Sang Sapurba and Demang Daun Lebar become null and void. Revolution is then ripe.

Merry Foolproof Christmas

Dear Friends,

I heard on the grapevine, while imbibing the 'nectar' of its fruits wakakaka, that two F5E engines had been moved from Argentina to the Antarctic.

Apparently a fat bloke at the South Pole, who likes to dress in red, is in trouble with the RSPCA for alleged cruelty to some animals with antlers, one of which has a big red nose.

The RSPCA claimed Fattie had subjected those strange animals with enormous loads around this time of the year for the last several decades. They weren't able to nab him before because he has been changing address from South Pole to North Pole and then back, and to and fro, so on so forth.

They've finally succeeded, that is, in apprehending him. The animals have been taken away to a vet for examination, but Fattie is out on bail, claiming he has a vital 'schedule' to keep (it seems tonight) or he will suffer loss of reputation ... yadda yadda.

Anyway, being the innovative type, the impounding of his animals by RSPCA has not fazed him in the least. Bloke purchased the 2 F5E engines to fit on his sleigh.


However his missus told him it won't be brilliant at all to visit Malaysia at this point in time with his reconfigured transportation. I heard he's likely to give the Peninsula a miss, but will still keep the date with Sabah and Sarawak.

So if Malaysian parents have a hard time tomorrow explaining to their lil' sweet ones why their stockings aren't filled, I suggest they dob in a local bloke by the name of Zahidi.

The elections screening committee is due to meet in two days time and vet through all the contestants but the main agenda will be the "fight for the  Deputy Presidents Posts." Both candidates election machinery are in full swing and audie61 received an sms at 13.03 pm and after verifications from the source we decided to upload.

The sms," We received report from the ground that my honorable opponent  is going round to ask delegates to sign a petition to support him.We are monitoring the situation,should there be any element of ministerialpower abuse we may consider making REPORT TO THE RELEVANT AUTHORITIES."

This is a serious matter and the Presidential candidate and our Preferred source in SPDP also concur with Philip Ngo that if there are abuse of power the Candidate must TAKE THE HONOURABLE STEPS AND MEASURES….It's for you to judge the man himself and we leave it to him.

Meanwhile an upcoming prominent young lawyer who has an eye for one of the SPDP areas met audie61 and said that that President Mawan shoud just leave his "machais" to do his work especially with the elections as he is seen now being "dictatorial' and not democratic. I thought SPDP means ,"Sarawak Peoples Democratic Party" and this is even worse than the the Communist bloc Parties.  Lets see a change here or else the people will change the YBS of SPDP. 

SPDP TGA will be held on the 28th-30th December in Kuching at the Civic Centre and all eyes will be focus on the candidates who will be vying for positions in the Leadership.

The order of the day at Jabatan Pelajaran Selangor, Kelana Jaya.

When I arrived at the Jabatan Pelajaran Selangor in Kelana Jaya Centrepoint yesterday morning I sort of knew that it was going to be not such a nice day. I was there to ascertain why my son, Adam's registration for Std 1 in 2010 was taking so long to process. And it was less than 3 weeks to schools re-opening. He still didn't have a confirmed place in the school of our choice. Or any other school for that matter. We had been told earlier in the month when we registered Adam at the school that we should wait for confirmation from the Education Department which will send us a letter of confirmation in the self-addressed envelope we provided for the purpose. So we waited. And nothing happened which was the reason I found myself at the Jabatan yesterday morning.

My wife and I had been there once before and had a taste of the less-than-enthusiastic service provided by the staff in the Jabatan lobby. We could have called the number given on the form for such enquiries. Except that the number given was almost perpetually engaged and when the call was connected nobody picked up the phone. There is a good reason for this which I shall tell you later. Now, back to the morning's visit.

A multi-tasking pegawai Jabatan Pelajaran Selangor. Propping up the ladder. Holding the banner and speaking on the handphone. All at the same time. Wah!

On arrival I noticed that there was a hive of activity around the entrance to the Jabatan Pelajaran Selangor. On closer scrutiny I saw that there were a group of 3-4 pegawai (officers) making rather amateurish and vain attempts at putting up a bright yellow banner across the entrance. The banner informed that there was to be an official visit by the Pengarah Pelajaran Selangor (Director of Education of Selangor - what a grand title eh?) later that afternoon for the jabatan's peresmian (opening, launch...whatever.)

First thought that came to my mind, "Shit! There goes any work and service for the public today!" Then I took a closer look at the 'team'. 4 officers. How do I know they were officers, and quite high level ones too? They all wore long sleeved shirts and gawdy unfashionable ties and had extra large name tags on their breast pockets. And so, 4 officers of the Selangor Education Department were engaged in putting up a banner to welcome their 'boss' la. Oh I forgot to mention that there were also another 4 female pegawai's watching their colleagues struggle with the big yellow banner. So who's doing the work for the day? Or is the VIP visit the work of the day?

Typical scene at the lobby. People clueless about what to do.

Anyway, I walked past the perspiring officers into the lobby. Crowded with people. How many officers attending to the people? None. There was the receptionist/operator who looked and sounded like she was at the end of her tether from being harassed by the constant stream of people asking her questions. Of course she has no time to answer the phone. In fact she had taken the phone off the hook! That was the reason why the phone was always engaged when I called. And the only time she replaced the handset was when she needed to make a call. That was when I got a ringing tone when I called and also the reason why nobody answered the call. She was just too busy. The receptionist/operator was doing everything there at the reception counter. Except answer the phone.

My wife took a queue number and waited in line. We were the 10th in the queue. Since we only needed to ask a simple question which probably required a simple answer which would take all of 7 seconds I decided to walk over to the banner-hanging pegawai's. The one I approached was quite eager to be helpful. I related my request and he waved his colleague over and asked him to assist me. We followed this guy back to the counter. Related our problem. Adam needs to have his registration confirmed for the 2010 school year.

Peg: Oh cam tu ya? Nama? Sijil pelahiran?

(we handed those over. the pegawai proceeds to start clicking buttons on the computer keyboard. Then a chilling look came over his face. You know that type of look that you get from someone you're confident of knowing his work and suddenly shows that he isn't exactly sure what he is doing? He clicks some more buttons......became more puzzled...)

Peg: (to his colleague) Eh! Mengapa cam ni ah?


(another guy comes over and says something to him that I could not hear.)

Peg #2: This case you have to get chop from the school on birth cert. Your child birth cert don't have chop. And we don't have record of your son's registration. Sekolah mesti bagi chop kalau sudah berdaftar. Kita taada record la. Lagi baik you balik tanya sekolah.


(My wife and I muttered some rather strong words under our breath and moved away from the counter. We drove to our next appointment across town. On the drive we called the school to relate to the kerani (clerk) in charge of registration what Peg #2 had said.)

Kerani: No, we only bagi chop selepas registration da approved. Kita sudah hantar borang berdaftaran ke jabatan pelajaran da.

After having lunch we drove back to the Jabatan in Kelana Jaya to try and sort out the mess that was fast building up. It was 2.30 pm. This time there were even more pegawai's standing at the entrance. Some even in jackets. My wife took a queue number. I decided to approach one of the suits with a big name tag.

Me: Excuse me Encik....

Big Peg: (Sternly) Apa? Pegi beratur sana. (What? Go queue up there.)

Me: Excuse me are you an officer here?

Big Peg: (Getting pissed off a bit) Ya.

Me: Why are you so rude?

Big Peg: (Starting to get even more pissed off......)

Me: (changing tactic a bit) So sorry to disturb you, sir. But may I ask which department you represent?

Big Peg: Pengurusan Sekolah( schools management)

Me (thinking: Perfect!)


The Big Peg begrudgingly said something which merely meant that I should go stand in the queue and wait my turn. Okay.

While I was in line I saw the VIP guest arrive with his entourage. The big wig. The state director of education. Coming to check out the new office. They were ushered into a VIP holding room which was in the lobby area and had glass walls so all can watch the proceedings inside. I watched. The usual posturing. Bows, limp handshakes, forced smiles.

I decided to exercise a right. I went up to the tudung-ed lady guarding the door.

Me: Excuse me. Is that the Pengarah Pelajaran?

TL: Yes. Ada apa hal?

Me: I would like to speak to him

TL: Sorry you cannot. He is having a meeting.


(I wave to the pengarah. He waved back to signal that I cannot proceed. I opened the door anyway.....)

Me: Excuse me Dr. XXXX. My name is Patrick. I understand you are the state education director. May I ask you a question as a member of the Rakyat?

DES: Oh yes, come in. You're the...apa namanya...actor ya? Ya? Ada apa hal? Come, come duduk, duduk....


I proceeded to inform him that all I wanted as a parent and a member of the Rakyat is to know what is the education department's procedure for registering children for school when they move from one part of Selangor to another.

Me: The school tells me this and your pegawai tells me that. As a parent I am worried.


While this short conversation was going on, the Big Peg I met earlier who was also in room probably because he was the local big shot was getting was getting really upset that I had managed to invade the big VIP gathering despite being told to queue at the counter. But ....

DES: (after listening to me...) Oh tu takde masaalah. Kan? (looking over at Big Peg) Kasi selesaikan la. Ya?


After the big pronouncement from the VIP there were smiles all round the room as all the pegawai's gathered felt more comfortable that my intrusion wasn't going to be an issue with the boss. I said my thank you's and went back to the counter. This time the pegawai at the counter seemed to be a little more friendly and helpful. He'd seen me in the room with the Pengarah.

Peg#2: Ini masaalah kecil je. Tak payar pegi jumpa pengarah. Ini kita boleh selesaikan. Senang je. Encik bagi nombor talipon, saya akan call balik selepas I dapat keterangan case ni.

Me: Bila encik nak talipon?

Peg#2: Esok.

Mr. Saya-talipon-esok. Suitable togged up for the big boss's visit. First time I met him he was just in shirt sleeves.

As we left the Jabatan Pelajaran Selangor, Kelana Jaya Centrepoint we past another couple trying to explain to the button clicking pegawai their predicament. It was almost exactly the same as ours. The father was trying to explain that he didn't have time to make many visits to the Jabatan and to shuttle from school to jabatan numerous times. He was a blue collar worker and could not afford to take time off or his family would have no food on the table for the day. But this father was a good Malaysian. Non-confrontational. He would accept what the Tuan Pegawai told him. Polite. He would never think of barging into the Pengarah Pelajaran Selangor's VIP reception. His family will go hungry for a few days before his daughter gets to go to school.

The pegawai will just shrug and click some more buttons on the keyboard.

NIAMAH!!!

p/s it is now 3:37 pm. The 'esok' call has not come yet. In the meantime, my wife went to the school and was told that my son has already been allocated a place in Std 1, 2010. All they needed now was the approval letter from...where?

Jabatan Pelajaran Selangor!!!

This is the state of things in Malaysia? That even after the Pengarah 'selesai' things, they still don't get done.

Them: Hiyah! Masaalah kecil je? Jangan risau. Tunggu la.

Us: Baik, tuan.

Singapura terdesak

Pasti ramai di antara kita merindui zaman Dr Mahathir yang tak pernah kasi muka pada Singapura. Ini ada satu cerita bagaimana Lee Kuan Yew dikenakan Dr Mahathir semasa kedua-dua mereka Perdana Menteri.

Ada satu masa Lee Kuan Yew dikejutkan oleh bunyi talipon pada pukul 4 pagi. Dia angkat talipon dan dengar Menteri Kesihatannya menalipon.

Cakap omputih skit. Taulah Singapura ni pisang; kuning diluar omputih di dalam.

"Sir, it's the Minister of Health here. Sorry to bother you at this hour but there is an emergency! I've just received word that the Durex factory in Bukit Timah has been burnt to the ground. It is estimated that the entire Singapore supply of condoms will be gone by the end of the week."

Rupanya kilang kondom di Bukit Timah terbakar dan Singapura akan kehabisan kondom. Mereka takut ini akan menyebabkan kenaikkan kadar penduduk.

Lee Kuan Yew terkejut, "What a disaster! The economy will never be able to cope with all those unwanted babies - we'll be ruined! We're going to have to ship some condoms in from abroad..."

Mereka mahu impot segera kondom.

Menteri tersebut bertanya, "Indonesia?"

Lee Kuan Yew tak mahu, "No chance! The tabloids will have a field day on this one!"

Dia tak mahu pasal malu.

Menteri bertanya lagi, "What about Malaysia?"

Lee Kuan Yew agak selesa tapi perangai kiasu tak mahu kalah tidak boleh buang.

"Maybe ... but we don't want them to know that we are stuck. Call their Prime Minister to tell him we need one million condoms; coloured white and red; ten inches long and eight inches thick! That way they'll know how big we really are!"

Tak mahu kalah. Macam Cina Singapura punya jaguh-jaguh.

Kesian Menteri tersebut kena panggil Dr Mahathir. Nasib dia sedia menolong puak-puak kiasu ini yang sedang dalam keadaan terdesak.

Tiga hari kemudian, satu penerbangan sampaikan ke lapangan terbang Changi penuh dengan kotal-kotak. Lee Kuan Yew begitu lega lalu dia sendiri berlari mendapatkan kotak-kotak untuk dibuka segera.

Terdapat dalam kotak kondom-kondom seperti yang dipesan. Panjang 10 inci, lebar 8 inci, dan berwarna merah dan putih.

Lee Kuan Yew sedar pada setiap kondom itu ada tulisan kecil. Diambil cermin mata bacanya. Tertulis:
